Terms of Service

These Terms of Service (“Terms”) govern your use of puntacanatourism.com and its articles, newsletters, links, and other features (collectively, the “Site”). The Site is operated by The Travel Spark Company LLC (“Travel Spark,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
1. Travel Information Service
Punta Cana Tourism is an independent travel-information and publishing website. Unless we expressly say otherwise, we are not a tour operator, travel agency, airline, hotel, transportation provider, insurer, or booking platform. We provide destination guides, recommendations, comparisons, and links intended to help visitors research a trip.
Travel conditions can change quickly. Prices, schedules, availability, entry requirements, weather, closures, safety conditions, accessibility, and the details of third-party products may change after an article is published. Although we aim to provide useful and accurate information, you are responsible for confirming important details with official authorities and the relevant provider before relying on them or making a purchase.
2. Eligibility
You must be legally capable of entering into these Terms to use the Site. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Affiliate Relationships and Advertising
The Site contains affiliate links. We may earn a commission when you click a link or complete a qualifying purchase, including through travel partners such as Viator and Expedia. This generally does not increase the price you pay. Commercial relationships may influence which offers are available to us, but they do not change your responsibility to evaluate whether a product or service suits your needs.
Links, buttons, prices, availability displays, and descriptions supplied by a third party do not constitute our guarantee or endorsement of that party’s performance.
4. Third-Party Bookings and Services
When you follow a link to a booking platform or other third-party site, you leave Punta Cana Tourism. Any reservation, purchase, cancellation, refund, credit, dispute, injury claim, or other transaction is solely between you and that third party. Its terms, privacy policy, payment rules, cancellation policy, and customer-service procedures apply.
We do not control and are not responsible for a third party’s inventory, pricing, descriptions, acts, omissions, service quality, cancellations, insolvency, data practices, or performance. Contact the booking provider or operator directly about a third-party transaction.
5. Travel Decisions and Personal Responsibility
Travel involves inherent risks. You are responsible for your itinerary, documents, visas, health precautions, insurance, transportation, activities, belongings, and personal safety. Consider your health, experience, abilities, local conditions, and official travel advisories before participating in an activity. Nothing on the Site is legal, medical, financial, insurance, safety, or professional advice.
6. Permitted Use
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial travel research. You may not:
- Copy, republish, sell, license, scrape, or commercially exploit substantial portions of the Site without written permission.
- Use automated systems in a way that burdens, disrupts, or bypasses access controls on the Site.
- Attempt to gain unauthorized access to the Site, its accounts, servers, or connected systems.
- Introduce malware or use the Site for fraud, spam, harassment, unlawful activity, or infringement.
- Misrepresent an affiliation with us or use our branding in a confusing or unauthorized way.
- Remove copyright, trademark, attribution, or proprietary notices.
7. Intellectual Property
The Site and its original text, design, graphics, logos, page layouts, and other content are owned by or licensed to The Travel Spark Company LLC and are protected by intellectual-property laws. “Punta Cana Tourism,” our logos, and associated branding may not be used without prior written permission. Third-party names and marks remain the property of their respective owners.
8. Newsletter
If you subscribe to our newsletter, you agree to receive the emails described at signup. You can unsubscribe at any time using the link in an email. You must provide an email address you are authorized to use and may not use a newsletter form to submit another person’s information without permission.
9. Feedback and Communications
If you send us suggestions, corrections, or other feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or compensation. This does not transfer ownership of personal information, which is handled under our Privacy Policy.
10. Copyright Concerns
If you believe material on the Site infringes your copyright, email us with identification of the protected work, the material at issue and its location, your contact information, a good-faith statement that the use is unauthorized, and a statement that the information you provide is accurate and that you are authorized to act.
11. Disclaimer of Warranties
To the fullest extent permitted by law, the Site is provided “as is” and “as available.” We disclaim all express and implied warranties, including warranties of accuracy, completeness, currency, merchantability, fitness for a particular purpose, non-infringement, availability, and security. We do not warrant that the Site will be uninterrupted or error-free or that any destination, provider, activity, or offer will meet your expectations.
Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
12. Limitation of Liability
To the fullest extent permitted by law, The Travel Spark Company LLC and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits or data, personal injury, property damage, travel disruption, or costs arising from or related to your use of the Site, reliance on its content, or dealings with a third party.
To the fullest extent permitted by applicable law, our aggregate liability for all claims relating to the Site will not exceed the amount you paid directly to us for use of the Site during the six months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be excluded or limited.
13. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Travel Spark Company LLC and its owners, officers, employees, contractors, and agents from claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another person’s rights.
14. Changes, Suspension, and Termination
We may modify the Site or these Terms, or suspend or discontinue access, at any time. Updated Terms become effective when posted unless a later date is stated. Your continued use after an update means you accept the revised Terms. Provisions that by their nature should survive termination will remain in effect.
15. General
These Terms and the Privacy Policy are the entire agreement between you and us concerning the Site. If any provision is found unenforceable, it will be modified only as much as necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or transfer of the Site or business.
